These Terms & Conditions (“Terms”) are a binding agreement between you and:

Throughout these Terms, the words “we”, “us”, “our”, “Company”, or “Graphe” refer to Graphe Limited.

The words “you” or “User” refer to any individual or business accessing or using our website, application, or services.

The terms “Website” and “App” refer to Graphe’s publicly accessible domains, subdomains, and mobile applications.

1. Acceptance of Terms

By accessing or using Graphe’s website, app, or services (collectively, the “Service”), including uploading designs, placing orders, browsing products, or making purchases, you agree to be bound by:

  1. These Terms & Conditions
  2. Our Privacy Policy
  3. Any additional terms disclosed during purchase or promotional campaigns

If you do not agree to these Terms, do not use the Service.

We may modify these Terms from time to time. The most recent version will always be available on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Eligibility

You may use Graphe only if:

  • You are at least 18 years old
  • You can form a legally binding contract
  • You comply with all applicable laws
  • If acting on behalf of a business, you are authorised to bind that business

3. Description of Service

Graphe provides an online print-on-demand service allowing users to:

  • Upload their own images, designs or artwork
  • Order physical printed products and have them shipped to selected addresses

Graphe is not a marketplace for browsing third-party seller listings unless otherwise specified.

4. User Content & Design Uploads

4.1 Ownership

You retain ownership of any designs, artwork, images, logos, or text you upload (“Content”).

4.2 License Granted to Graphe

By uploading Content to Graphe, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sub-licensable license to:

  • Store
  • Reproduce
  • Modify for technical purposes (e.g., resizing, formatting for print)
  • Print
  • Fulfil and ship orders
  • Use mockups for order previews
  • Use anonymised samples for quality control

This license exists solely for the purpose of operating and improving the Service, unless you separately agree to marketing use.

4.3 You Represent and Warrant That:

  • You own the Content or have legal rights to use it
  • The Content does not infringe any copyright, trademark, privacy, publicity, or other rights
  • The Content does not contain unlawful, defamatory, offensive, or prohibited material

You are solely responsible for the Content you upload.

5. Prohibited Content

You may not upload or print Content that:

  • Violates intellectual property rights
  • Contains hate speech or discriminatory content
  • Promotes violence or illegal activity
  • Promotes or endorses political views and parties
  • Contains sexually explicit material (unless explicitly allowed for certain product categories)
  • Violates any applicable laws

We reserve the right to refuse, cancel, or remove orders that violate these rules without prior notice.

6. Orders & Production

6.1 Order Confirmation

Orders are confirmed once payment has been successfully processed.

6.2 Production

All products are made to order. Once production begins, orders cannot be cancelled except where required by law.

6.3 Proofing Responsibility

You are responsible for reviewing:

  • Spelling
  • Layout
  • Design positioning
  • Colours
  • Sizing and print resolution

Graphe is not responsible for errors in artwork submitted by you.

7. Pricing & Payments

  • Prices are vary according to the size and materials selected for print and are displayed on the App
  • Shipping and taxes may be added at checkout
  • Payment must be made in full before production begins

We may use third-party payment processors. By submitting payment, you authorise us and our payment providers to charge your selected payment method.

We reserve the right to correct pricing errors.

8. Refunds & Returns

Because products are custom-made:

  • All sales are generally final
  • We do not accept returns for buyer’s remorse or incorrect design submission

However, we will replace or refund products if:

  • The product is defective
  • There was a production error
  • The product was damaged during shipping

Claims must be submitted within 14 days of delivery with photographic evidence.

9. Shipping & Delivery

Delivery times are estimates only.

We are not responsible for delays caused by:

  • Couriers
  • Customs
  • Incorrect address information
  • Force majeure events

10. Intellectual Property

All Website content, branding, logos, software, design tools, and technology belong to Graphe or its licensors.

You may not:

  • Reverse engineer the Service
  • Copy website materials
  • Use our trademarks without written consent
  • Scrape or automate access

11. User Conduct

You agree not to:

  • Interfere with the Service
  • Upload malicious code
  • Attempt unauthorised access
  • Use bots or scraping tools
  • Submit fraudulent payments

We may suspend or terminate accounts for violations.

12. Third-Party Services

We may use third-party providers for:

  • Payments
  • Hosting
  • Printing facilities
  • Shipping

We are not responsible for third-party policies or actions beyond our control.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

We do not guarantee:

  • Perfect colour matching (screen vs printed output may vary)
  • Uninterrupted service
  • Error-free operation

To the fullest extent permitted by law, we disclaim all implied warranties.

14. Limitation of Liability

To the maximum extent permitted by law:

Graphe shall not be liable for:

  • Indirect damages
  • Loss of profits
  • Loss of data
  • Business interruption

Our total liability shall not exceed the amount paid by you for the order in question.

Some jurisdictions may not allow certain limitations.

15. Indemnification

You agree to indemnify and hold Graphe harmless from any claims arising from:

  • Your Content
  • Your violation of these Terms
  • Your infringement of third-party rights

16. Termination

We may suspend or terminate your access if:

  • You violate these Terms
  • You engage in unlawful activity
  • Fraudulent behaviour is suspected

Termination does not affect payment obligations.

17. Privacy

Your use of the Service is governed by our Privacy Policy.

18. Governing Law
